Can an arbitrator in Israel compel a party to produce documents?

Yes. Under Section 25 of the International Commercial Arbitration Law 2024 (ICA Law) and Section 26 of the Arbitration Law 1968, an arbitral tribunal may order a party to produce specified documents. If the party refuses, the tribunal can draw an adverse inference — treating the missing documents as supporting the other side's case — or the requesting party can apply to the District Court for a judicial production order under Section 27 (ICA Law) or Section 28 (Arbitration Law 1968). Court-ordered production backed by NIS 5,000-per-day contempt fines is rarely ignored.
