Debt Collection

What happens if the debtor has no assets to attach?

If the Enforcement Authority's investigation reveals no attachable assets — no bank balance, no salary, no real estate — the enforcement file may be placed in a holding status. The file remains open and can be reactivated if the debtor's financial position improves. The debtor may also be summoned to a financial disclosure hearing before the Enforcement Authority, where they must declare all assets and income under oath. Deliberately concealing assets at such a hearing is a criminal offence. In cases of genuine insolvency, the creditor may initiate bankruptcy proceedings against an individual debtor or liquidation proceedings against a company.
