It depends on when it is made. An inheritance agreement concluded after marriage does not require court approval — it needs only to be in writing and signed by both parties. An agreement made before marriage must be approved by the Family Court under Section 8(b) of the Inheritance Law before it becomes binding.

The court approval fee is approximately NIS 800–1,200 and the hearing is usually procedural unless one party contests the application.
