Can an Israeli family court order a parent living abroad to pay child support for a child in Israel?
Israeli family courts derive jurisdiction from the child's habitual residence in Israel. Under the Family Courts Law 5755-1995, the court most connected to the child's daily life is the competent forum for maintenance claims. Section 3 of the Legal Capacity and Guardianship Law 5722-1962 directs that the child's best interests govern all proceedings, regardless of the absent parent's nationality or location. The court can proceed with issuing a child support order even where the foreign-resident parent does not appear, provided notice has been served through the legal assistance mechanisms under the Legal Assistance Between States Law 5757-1977 or an applicable bilateral treaty.
The enforcement challenge begins after the Israeli order is issued. If the parent lives in a country that participates in the Hague Convention on the International Recovery of Child Support and Other Forms of Family Maintenance — to which Israel acceded in 2014 — the Israeli maintenance order can be transmitted through the designated Central Authority and registered in the foreign country's court for local enforcement. For countries without a treaty relationship with Israel, a fresh enforcement lawsuit must be filed abroad using the Israeli order as evidence. Regardless of where the foreign parent lives, the custodial parent in Israel should register the support order with the Execution Office (Hotza'a Lepoal) so that any Israeli bank accounts, property, or income the absent parent has in Israel can be attached without delay.
- Governing law: Section 3, Legal Capacity and Guardianship Law 5722-1962; Family Courts Law 5755-1995; Legal Assistance Between States Law 5757-1977
- Competent authority: Family Court (Beit Mishpat LeMishpacha) in the district where the child resides; Execution Office (Hotza'a Lepoal) for enforcement
- International service timeline: service through reciprocal legal assistance channels typically takes 60–90 days for Western countries
- Hague Maintenance Convention: in force for Israel since 2014 — Israeli orders can be registered for enforcement in most European, US, and Commonwealth jurisdictions through the Central Authority
- Execution Office registration fee: approximately NIS 1,000–2,500 (2026) depending on the monthly amount claimed
