Can a developer contract exclude or shorten the statutory warranty in Israel?

No. The warranty periods set out in Sections 4-4B and the Schedule to the Sale of Apartments Law 5733-1973 are mandatory and cannot be waived or shortened by contract. Any clause in a purchase agreement that purports to limit, exclude, or reduce these warranty periods is void and unenforceable under the Contracts (General Part) Law 5733-1973 and the Consumer Protection Law 5741-1981. You retain full statutory warranty rights regardless of what the contract says.
