Is a mandatory arbitration clause in a consumer contract enforceable in Israel?

Consumer arbitration clauses face serious scrutiny under the Standard Contracts Law 5743-1982. Section 4(5) of that law treats as oppressive any term in a standard-form consumer contract that denies the consumer access to the courts or requires disproportionate dispute resolution costs. Courts routinely strike down clauses that deprive consumers of rights under the Consumer Protection Law 5741-1981, require arbitrator fees disproportionate to the claim value, or require arbitration in a distant location. The Consumer Protection Authority can also challenge such clauses independently.
