Does a real estate agent in Israel have to be licensed?

Yes. The Real Estate Brokers Law 5756-1996 makes it illegal to act as a property broker in Israel without a license issued through the Ministry of Justice. A person who brokers a deal without that license commits an offense and, just as importantly, cannot legally sue to collect commission. Before signing any commission agreement, a buyer or seller can and should verify the agent holds a current license number.

The Real Estate Brokers Law regulates who may earn commission for connecting buyers and sellers of Israeli property. To qualify, a broker must pass the state licensing examination and register with the Registrar of Real Estate Brokers at the Ministry of Justice. The law provides that only a licensed broker who has a signed written brokerage agreement, and who was the "effective cause" of the transaction, is entitled to a fee. Courts apply this strictly, so an agent who never held a valid license at the time of the deal has no enforceable claim to commission, even if they genuinely introduced the parties.

For a foreign buyer, this rule is a practical safeguard. Anyone who asks you to sign a commission form should hold a license, and you are entitled to see the number and confirm it on the public register. Commission is negotiable and typically runs around 2% plus VAT from each side, but no fee is owed at all unless the statutory conditions are met, including a written agreement signed before the property is shown.
