Can I mediate if court proceedings are already underway?

Yes. Mediation can be — and very often is — used after court or arbitration proceedings have commenced. The proceedings can be stayed (by consent) while mediation is attempted. If mediation succeeds, the proceedings are discontinued. If it fails, they resume. Courts are generally supportive of stays for mediation.
